Who is not a member of the ICC?
Believe it or not, the three first world powers – United States, Russia, and China – aren’t part of the ICC, each for its own particular reasons.
What ICC means?
The International Criminal Court
The International Criminal Court in The Hague prosecutes those accused of war crimes, crimes against humanity and genocide. In 1998, 60 countries signed the Rome Statute after it was opened for signature by the United Nations.
What does it mean to be a member of the ICC?
When we say “joining the International Criminal Court” we are referring to states ratifying, or acceding to, the Rome Statute, the Court’s founding treaty. ICC member states also take on a whole range of legal, and moral, obligations.
Why is the US not a member of the ICC?

Who can ICC prosecute?
Yes, in two cases. The Court can prosecute crimes committed on the territory of a country that has ratified the Rome Statute whether the accused are citizens of that country or another. (There is an exception with regards to members of peacekeeping forces though; see below).

Is the ICC weak?

They also named common weaknesses, including its reliance on state cooperation, challenges in administrative functions, and, from the perspective of largely Defense personnel, an unfair disadvantage against the Defense.

Should the United States be a member of the ICC?

Is the ICC a court of last resort?

The ICC does not shift this responsibility. It is a court of last resort.

When does the ICC have jurisdiction?
Under what is known as the “principle of complementarity,” the ICC may only exercise its jurisdiction when a country is either unwilling or genuinely unable to investigate and prosecute these grave crimes.
